Grand Rapids, MN (NNCNOW.COM) -- The 71-year-old Hibbing man who allegedly hit and killed a man on a scooter while on under the influence of alcohol has been charged.

Lyle Elmer White made his first appearance in the Itasca County Court Wednesday where he was charged with two counts of Criminal Vehicular Homicide.

White's bail was set at $25,000 without conditions or released White without bail with the following conditions of release: keep court appearances, keep in contact with his attorney, remain law abiding, no alcohol or drugs and be subject to random testing, report to jail for booking and no driving.

In a criminal complaint filed on Monday, Deputies says White was driving his truck on September 29 at 12:18 p.m. on Itasca County Road 29 and hit a person driving a power motor scooter.

Deputies say that White had left his hunting shack and was traveling back to his home in Hibbing at the time of the accident.

White submitted a urine sample which revealed an alcohol concentration of 0.09.

A blood sample was obtained from the victim of the crash and analysis did not detect the presence of alcohol or drugs.

A trooper investigated the scene and says that had White been sober and traveling the speed limit, that there is a good chance that the crash would not have occurred.

The night before the accident, White told officers that he had four or five drinks of brandy mixed with coffee at midnight, and one drink at about 5:00 a.m.

White stated that he did not have anything to drink after that.

Whtie was found guilty in 1993 with a Driving While Impaired charge.

White faces a sentence of up to 20 years in prison.
