St. Paul, MN (Northland's NewsCenter) - A Top Republican lawmaker is now calling on Representative Kerry Gauthier to resign following a scandal surrounding a sexual encounter on Thompson Hill.

House Speaker Kurt Zellers issued this statement:

“While no charges have been filed, the reported incident with a minor and subsequent lying to police show Representative Gauthier to be unfit to continue serving his constituents in Duluth.

“I believe we have given Representative Gauthier and the Democrat Caucus a respectful amount of time to address this situation on their own. Representative Gauthier’s actions are not becoming of a member of the House of Representatives, and today I am calling on him to resign from the Legislature.”

Police reports indicate 56-year old Gauthier was engaged in a sexual act with a 17 year old whom he met through the internet website Craigslist on the night of July 22nd.

The report states both parties have told police that the sex "was" consensual and that no money was exchanged.

The St. Louis County attorney announced Thursday that it won't file charges against the Representative. In a letter to Duluth Police, The County Attorney said no charges are warranted because the age of consent in Minnesota is 16.
