Man Charged Following Struggle with Off-Duty Officer

Hermantown, MN (Northland's NewsCenter) - The 25 year old who was arrested for getting into a scuffle with an off-duty Hermantown Police Officer, has been charged.

Bryan James Hathaway has been charged with 4th Degree Assault upon a Police Officer, Obstructing the Legal Process, Fleeing on Foot and Possession of Stolen Property after an assault that happened Monday night, at the Walmart on Highway 53.

Police say Hermantown Police Officer, Kody Vedder, who was in uniform, spotted the man acting suspiciously inside a vehicle in the parking lot.

Officer Vedder approached the man while calling for backup. That's when Hathaway began to struggle with the Vedder, knocking her to the ground. Hathaway then fled from the scene.

A number of law enforcement agencies searched nearby businesses, parking lots and wooded areas until they found Hathaway and took him into custody at the Volkswagen Dealership.

Officer Vedder sustained scratches and bruises and will undergo further testing for injuries sustained in the assault.

Three stolen cell phones were located in one of the bags Hathaway was in possession of while in the back seat of the car.

Police say the suspect had been inside the store with three others. One was arrested for an outstanding warrant. Another was cited for possession of a small amount of Marijuana.
