Sexual Assault Allegations Against Duluth Doctor

Several witnesses took the witness stand in Douglas County Court Tuesday all alleging they were sexually assaulted by a Duluth doctor.

LeAnn Wallace attended the motion hearing today, and has more.

51-year old Javier Enrique De La Garza sat shaking his head in a Douglas County Courtroom Tuesday morning.

De La Garza is a doctor at Saint Luke's Hospital in Duluth but he has reached an agreement with the Minnesota Board of Medical Practice to stop practicing medicine while the board investigates complaints against him.

According to a criminal complaint, De La Garza engaged in the inappropriate touching of at least one of his female patients during medical examinations.

But five other have come forward to testify that they too were inappropriately touched. The five women claimed in court today that De La Garza preformed unnecessary and sometimes embarrassing medical examinations on them.

Defense attorney Rick Gondik says two of the witnesses were under anesthesia during the alleged misconduct and says he's absolutely flabbergasted that there's even an attempt to get that quality of testimony into this serious trial.

De Le Garza has pleaded not guilty in this case.

A decision by Judge as to whether this testimony will be allowed at trial...is expected within the next several weeks.
