Minnesota Court Rules Against Northshore Mining

The Minnesota Court of Appeals Tuesday agreed with the Minnesota Center for Environmental Advocacy and a state agency that a standard to protect the health of Silver Bay area residents should remain in place.

Northshore Mining, which now owns the old Reserve Mining operation in Silver Bay, asked the court in May 2007 to eliminate the “control-city standard” in the company’s air pollution permit, arguing that the standard is obsolete.

That standard, which was first established by the federal court more than 30 years ago, says there can not be any more asbestos fibers in the air in Silver Bay than there is in St. Paul. Inhaling asbestos fibers is linked to respiratory illnesses including lung cancer and mesothelioma.
