Superior Police Officer Charged

An officer with the Superior Police Department is facing several charges including Second Degree Assault for allegedly pulling a gun on a man at a Two Harbors gas station.

The Complaint says 45-year-old Ross Magnuson threatened and pointed his gun at Philip Hoberg.

On Friday Magnuson was charged with making terroristic threats, disorderly conduct and recklessly handling a dangerous weapon.
It was an uncommon event in the Northland.

"People don't always pull guns on each other here in Lake County," said Lake County Attorney Russ Conrow.

He says this incident was surprising.

The Two Harbors Police Department investigated, and arrested Magnuson on Friday.

In the complaint, Hoberg said Magnuson flipped him off while they were driving on Highway 61.

Once in Two Harbors, they stopped at a gas station, when the off-duty officer got out of his vehicle and stuck his head in Hoberg's open moon roof as he yelled at him.

Hoberg says he told Magnuson he would close the window.

Magnuson came around the front of Hoberg's car where Hoberg stepped out of the car to talk with him.

That's when the twelve-year veteran police officer is reported to have pulled out a gun and pointed it at Hoberg.

Hoberg says he and Magnuson's wife, tried to calm Magnuson down.

As Lake County authorities investigate the incident the Superior Police Department is conducting its own internal probe.

They refused to comment on the on-going investigation.

Magnuson has been put on administrative leave from the Superior Police Department for the time being.

Lake County Attorney Conrow says Magnuson's next court appearance was scheduled for September second, but it may be post-poned.

We talked to Magnuson today.

When asked if he knew Hoberg before the incident, he hesitated, then said his attorney has advised him not to speak about the situation until he is able to tell his full story.

Am surprised this shockes anyone in theis area. this is a continueing on going thing with the superior police deptartment.This situation is another situation of a superior officer inciting a situation using aggresive tactics and show of force when nothing was needed.

This guy is not fit for duty, period! Superior should not tarnish its good force with this bad apple. The fact this nut case slid by for 12 years in horrible. Get him off the force and don't protect him because we need to be protected from him. Drugs, bad marriage, money problems are not an excuse for pulling a gun on someone. If anyone else did it they would be jailed, why is he free? We must let Superior know we don't want their officer running around Duluth with his anger and their guns.

"Broke Leather"..? If the officer is so used to this type of situation, why would he pull out his weapon (implying willingness to use deadly force) over a verbal altercation? I'm no police officer, but I can't believe there is anything in the "Handbook" about "breaking leather" when someone flips you a digit. If all Officers of the law were unable to differentiate between "on" and "off" duty protocol, we'd have county jails full of fast food workers in for "obstruction of cheesburger justice".

If his wife was trying to calm him down, she knew he was in the wrong. She also probably knows he has an anger problem. We don't need his kind on the street in uniform and he needs to be fired. Just wait, he'll claim stress/alcohol/money problems and try to check himself into rehab. This shopuld be a zero tolerance situation. Fire him, convict him and take away his guns before he kills someone over a lane change or something else trivial.

ROAD RAGE IN NOT RIGHT< EVEN FOR A COP> Giving the finger, his own wife having to calm him down does not sound like a police officer performing his duty. Sounds like he abused his position and should be fired and sent to jail like anyone else that would do such a thing. Being a cop should not be a factor. He pulled a gun in anger and should not be allowed to carry one anymore, they would strip a gun permit from anyone else that did that.

He "broke Leather" in response to a situation that he is use too.. he is A Policeman. They act as accordingly as the Police handbook says. Training dictates protection of self and eveything else around that officer. This officer was in the right.
