Duluth, MN (NNCNOW.com) - The Saint Louis County Planning Commission has voted to move forward on a proposed county–wide septic tank ordinance, with a slight adjustment to a controversial requirement.
According to Ted Troolin, Director of the County Environmental Services Department, Ordinance 61 is moving forward with the exception of the escrow requirement for most homes with a septic system.
The ordinance would require a home seller to provide a septic system Certificate of Compliance at the point of the home's sale, good for up to 5 years.
If that can't be provided, the original proposal required that 110 percent of a written estimate to install a compliant system would be escrowed by either the homebuyer or seller.
The Planning Commission is moving forward on the ordinance with the proposed amendment that only properties near shoreline (1,000 ft. from lakefront, and 300 ft. from rivers and streams) will be subject to the escrow rule.
The matter will now be forwarded to the County Board.
A decision could come as early as February after more public input.
