Man charged with criminal-vehicular homicide three years after incident

Duluth, MN (NNCNOW.com) --- A 39- year- old Superior man has been charged in St. Louis County Court with criminal- vehicular homicide three years after the incident.

James Voltzke was the driver in an accident that killed Joseph Lofald, a passenger in the car. The accident happened near the intersection of Highway 53 and Swan Lake Road in Independence, MN, in April 2011.

Voltzke suffered a broken neck in the crash. He was arrested on suspicion of driving under the influence, but is only now facing charges because of a combination of reasons.

The Minnesota State Patrol says the lead investigating trooper retired shortly after the accident, and his submission of charges didn't go through the proper channels at the time.

Now three years later Voltzke is facing a potential ten years in prison and a fine of $20,000 if he is found guilty. His first appearance in court has been set for 1:15 p.m. on May 20.
